本プライバシーポリシー（以下「本ポリシー」）は、BitBIM（以下「当方」）がソフトウェア「Property Graph Editor for Archicad」（以下「本ソフトウェア」）および関連サービスに関して、個人情報をどのように収集、利用、取り扱うかを説明するものです。

This Privacy Policy ("Policy") describes how BitBIM ("we", "us", or "our") collects, uses, and handles personal information in connection with the software "Property Graph Editor for Archicad" ("Software") and related services.

1. 収集する情報 / Information We Collect

1.1 購入・試用時にお預かりする情報 / Information Collected at Purchase and Trial Download

本ソフトウェアの購入手続きと、試用版のダウンロードは、いずれも販売事業者である Lemon Squeezy のページで行われます。当方は、Lemon Squeezy から次の情報を受け取ります。

Both purchases and trial downloads are handled on the pages of Lemon Squeezy, which acts as merchant of record. We receive the following information from Lemon Squeezy:

  • お名前 / Name
  • メールアドレス / Email address
  • ライセンスキー、および購入・ライセンス認証の日時（ご購入の場合）/ License key, and the date and time of purchase and activation (for purchases)

試用版のダウンロードでは、お名前とメールアドレスのみをお預かりします。お支払いに関する情報は発生しません。

For trial downloads, only your name and email address are collected. No payment information is involved.

法人としてご購入の場合、購入者は法人であり、上記のお名前とメールアドレスはご担当者のものとなります。この場合に本ポリシーが対象とするのは、ご担当者個人に関する情報です。法人そのものに関する情報は、個人情報の保護に関する法律にいう個人情報には当たりません。

Where the purchaser is a corporation, the name and email address above are those of the individual contact person, and this Policy applies to that individual's information. Information relating to the corporation itself does not constitute "personal information" under the Act on the Protection of Personal Information of Japan.

1.2 決済情報 / Payment Information

本ソフトウェアの販売および決済は、販売事業者である Lemon Squeezy が行います。クレジットカード番号等の決済情報は同社が取り扱い、当方が受け取ることはありません。

The Software is sold, and payments are processed, by Lemon Squeezy as merchant of record. Credit card numbers and other payment details are handled by Lemon Squeezy and are never received by us.

1.3 ライセンス認証の際の通信 / Communication for License Validation

本ソフトウェアは、ライセンス認証を行うとき、およびその後にライセンスの有効性を確認するときに、Lemon Squeezy のサーバーと通信します。この通信で送信するのは次の情報だけです。

The Software communicates with Lemon Squeezy's servers when activating a license and when subsequently verifying that the license remains valid. Only the following information is transmitted:

  • ライセンスキー / License key
  • ライセンス認証時に Lemon Squeezy が発行した識別子 / An identifier issued by Lemon Squeezy at the time of activation
  • ご利用のOSの種別（Windows か macOS かの別のみ。バージョンやコンピューター名は含みません）/ The type of operating system (only whether it is Windows or macOS; no version or computer name is included)

この通信の性質上、Lemon Squeezy にはお客様のIPアドレスが伝わります。当方がIPアドレスを収集・保管することはありません。

By the nature of this communication, your IP address is visible to Lemon Squeezy. We do not collect or store IP addresses.

なお、試用期間を管理するために、お使いのコンピューターの名前とユーザー名から照合用の値を作成しますが、これはお客様のコンピューターの中だけで使用し、外部に送信することはありません。

To manage the trial period, the Software derives a verification value from your computer name and user name. This value is used only on your computer and is never transmitted.

1.4 収集しない情報 / Information We Do Not Collect

本ソフトウェアは以下の情報を収集しません。

The Software does not collect:

  • Archicad内のプロジェクトデータや設計データ / Project data or design data within Archicad
  • 利用統計（操作ログ、機能使用頻度等）/ Usage telemetry (operation logs, feature usage frequency, etc.)
  • Cookieやブラウザ情報 / Cookies or browser information

2. 情報の利用目的 / How We Use Your Information

収集した個人情報は、以下の目的で利用します。

We use the collected personal information for the following purposes:

  1. ライセンスの発行、管理、認証 / License issuance, management, and validation
  2. カスタマーサポートの提供 / Providing customer support
  3. 製品アップデートおよび重要なお知らせの送付 / Sending product updates and important notices
  4. 新製品・新機能・関連するサービスのご案内の送付（配信停止のお申し出があった場合は、以後お送りしません）/ Sending information about new products, new features, and related services (we will stop sending these upon your request)
  5. 法令遵守 / Compliance with legal obligations

3. 情報の共有 / Sharing of Information

当方は、以下の場合を除き、お客様の個人情報を第三者と共有しません。

We do not share your personal information with third parties except in the following cases:

3.1 販売事業者（Lemon Squeezy）/ Merchant of Record (Lemon Squeezy)

本ソフトウェアの購入手続きは Lemon Squeezy が行うため、購入に関する情報は同社が取得します。また、ライセンスの認証および有効性の確認のために、本ソフトウェアから同社へ1.3に記載した情報を送信します。同社における個人情報の取り扱いについては、 Lemon Squeezyのプライバシーポリシーをご参照ください。

Because purchases are processed by Lemon Squeezy, that company obtains the information relating to the purchase. In addition, the Software transmits the information described in section 1.3 to Lemon Squeezy in order to activate and verify licenses. Please refer to Lemon Squeezy's privacy policy for their handling of personal information.

3.2 法的開示 / Legal Disclosure

法令により求められる場合、または当方の権利・財産を保護するために必要な場合に、個人情報を開示することがあります。

We may disclose personal information when required by law or when necessary to protect our rights and property.

4. データの保存と安全管理 / Data Retention & Security

4.1 保存期間 / Retention Period

お客様の個人情報は、ライセンス契約の有効期間中、および適用法令で求められる期間、保存されます。

Your personal information is retained for the duration of your license agreement and for as long as required by applicable laws.

4.2 安全管理措置 / Security Measures

当方は、個人情報への不正アクセス、紛失、損害を防止するために適切な技術的・組織的セキュリティ対策を講じています。ただし、インターネットを介した通信方法に完全なセキュリティを保証することはできません。

We implement appropriate technical and organizational security measures to prevent unauthorized access, loss, or damage to personal information. However, no method of transmission over the Internet can be guaranteed to be completely secure.

5. お客様の権利 / Your Rights

5.1 個人情報保護法に基づく権利 / Rights under Japan's APPI

日本の個人情報保護法に基づき、お客様には以下の権利があります。

Under Japan's Act on the Protection of Personal Information (APPI), you have the following rights:

  • 個人情報の開示を求める権利 / Right to request disclosure
  • 個人情報の訂正、追加、または削除を求める権利 / Right to request correction, addition, or deletion
  • 個人情報の利用停止または消去を求める権利 / Right to request suspension of use or erasure
  • 第三者提供の停止を求める権利 / Right to request cessation of third-party disclosure

5.2 GDPRに基づく権利 / Rights under the GDPR

欧州経済領域（EEA）にお住まいの方は、GDPRにより、アクセス権、訂正権、消去権（「忘れられる権利」）、データポータビリティ権、処理制限権、異議申立権の各権利を有します。

If you reside in the European Economic Area (EEA), you are entitled to the rights granted under the GDPR, including the right of access, rectification, erasure ("right to be forgotten"), data portability, restriction of processing, and the right to object.

6. 未成年者のプライバシー / Children's Privacy

本ソフトウェアは16歳未満の方を対象としていません。当方は、16歳未満の方の個人情報を意図的に収集することはありません。

The Software is not intended for individuals under the age of 16. We do not knowingly collect personal information from anyone under 16 years of age.

7. 本ポリシーの変更 / Changes to This Policy

当方は、本ポリシーを随時更新する場合があります。重要な変更を行う場合は、メール等の適切な手段でお知らせします。変更後のポリシーは、本ページに掲載された時点から効力を生じます。

We may update this Policy from time to time. If we make significant changes, we will notify you through appropriate means such as email. The revised Policy becomes effective when posted on this page.

8. 準拠法・管轄裁判所 / Governing Law & Jurisdiction

本ポリシーは日本法に準拠し、日本法に従って解釈されるものとします。本ポリシーに起因または関連するすべての紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

This Policy shall be governed by and construed in accordance with the laws of Japan. Any disputes arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.
